After several confusions over GST rates for restaurants government has given the clear clarification about GST rules for restaurants.

For ordering the food there are two types of tax rates are collected. One is 12% and 18% it is also depends upon the restaurant type (Ac or non Ac Restaurant) whether the restaurant has the license to serve alcohol or not. The 12% and 18% rates include both CGST and SGST.5% rates for the restaurant which is under the composition scheme (up to the aggregate turnover of Rs.75lakh).

  1. 12% Tax rate - 6% is CGST and 6% is SGST
  2. 18% Tax rate – 9% is CGST and 9% is SGST

12% Tax will be collected for non-AC restaurants, roadside eateries(don’t serve alcohol), local delivery restaurants and parcel of pre-packed and pre-cooked namkeens sold from restaurants.18% tax will be collected for AC restaurants and the restaurant that serves liquor.

The CBEC has said that “the actual GST incidence will be lesser due to increased availability of input tax credit. To clear doubts about GST rates the tax department has launched the app GST Rate Finder. It is available on Google play and mobiles (android). This app will give the applicable GST rates on goods and services.
